Terms and Conditions

§ 1 Scope and Provider

These General Terms and Conditions (GTC) apply to all orders placed through the Basmala Designs online shop, operated by Mehmet-Ali Bilen, Lorenz-Hagen-Straße 21, 90461 Nuremberg ("Seller"). A consumer is any natural person who enters into a legal transaction primarily for private purposes.

§ 2 Conclusion of Contract

The product presentation is not a binding offer, but an invitation to order. By clicking the order button, you submit a binding offer to purchase. Receipt of the order will be confirmed immediately by email (this is not yet an acceptance). The contract is concluded when we declare acceptance or dispatch the goods.

§ 3 Prices and Shipping Costs

All prices are final prices. Due to the small business regulation according to § 19 UStG, no sales tax is calculated or shown. Shipping costs are shown separately during the ordering process.

§ 4 Custom-made Goods / Delivery Time

Some of our products are made to order; we also offer goods individually made to customer specifications (e.g., with personal text/name). The delivery time is indicated on the respective product page; for custom orders, the processing time may be extended.

§ 5 Payment

Payment options include PayPal, Klarna, or credit/debit card (Shopify Payments). The terms and conditions of the respective provider may apply.

§ 6 Delivery

Delivery to the specified address within Germany. Deliveries abroad only by separate agreement.

§ 7 Retention of Title

The goods remain our property until full payment has been received.

§ 8 Right of Withdrawal

Consumers have a statutory right of withdrawal (see separate withdrawal instructions). This does not apply to goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (§ 312g Abs. 2 Nr. 1 BGB).

§ 9 Warranty

The statutory warranty rights apply.

§ 10 Consumer Dispute Resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
